ICE agent shoots, wounds ‘criminal illegal’ migrant in NYC with boy, 5, sitting in back of his car: police, sources

ICE agents shot and wounded a suspected migrant gang member in the Bronx Thursday while a 5-year-old boy, believed to be his son, sat in the back of his SUV — sparking a large, rowdy protest and prompting Mayor Zohran Mamdani to demand the federal agency leave the city in a fiery speech.

The shooting happened outside 2 Marble Hill Ave. around 4:20 p.m. when the feds tried to arrest a 28-year-old “criminal illegal alien” from the Dominican Republic, and things quickly went off script, according to the Department of Homeland Security and sources.

“They shot this n—– out the car, bro,” one bystander is heard yelling on a video posted online. “This n—- over here got a AR. Look at this. That’s ICE. This is ICE, bro.”

The wounded man, identified by the NYPD as Oscar Belgal — whom the DHS alleged has ties to the Trinitarios gang — was shot in the neck but is expected to survive. He was seen being taken away from the hospital in a vehicle with blacked-out windows late Thursday night.

“ICE put the man in an unmarked vehicle and whisked him away,” Mamdani confirmed, noting he tried — and failed — to convince President Trump to release the alleged gangbanger from federal custody.

“For the past two hours, I’ve been on the phone with President Trump and [DHS] Secretary Mullin negotiating the release of the man ICE agents shot. Those negotiations were unsuccessful,” Hizzoner said.

Mamdani — who spoke over protesters’ chants labeling him “complicit” — called Immigration and Customs Enforcement “rotten to its core” and is an “agency that must be abolished” in the fiery speech.

“What does Trump have to say about all of this?” he demanded.

In the immediate aftermath of the shooting, Belgal was seen sitting handcuffed on the pavement while as many as a dozen agents swarmed the scene and kept bystanders back.

The young boy, who has not been identified but is believed to be Belgal’s son, was not injured.

Video footage from the scene shows police pulling a man from a silver SUV in handcuffs, while armed federal agents surround the vehicle — even as bystanders begin to gather on the sidewalk.

One man in a construction vest with a badge around his neck roamed around the vehicle holding a semi-automatic rifle, keeping bystanders back.

“I was in the store on Broadway and someone said someone’s getting shot,” one witness to the aftermath told The Post. “And then I came out and there was someone on the ground in handcuffs.

“There was a guy holding a gun up, looking around in case someone wanted to interfere,” he added. “He was ICE.”

The alleged criminal migrant has “a prior criminal conviction for grand larceny, and multiple prior arrests for assault, robbery, possession of drugs, and weapons possession,” the DHS said in a statement.

“This criminal illegal alien was arrested by the NYPD on December 7, 2023, but was released into the community a few days later by reckless Democrat sanctuary policies that put American lives at risk,” the statement read.

The NYPD confirmed Belgal has two prior arrests in the city — one for robbery in 2023, in which he pleaded guilty to fourth-degree grand larceny and received five years’ probation, and one for criminal sale of a controlled substance in 2025, which is still pending.

Sources said the feds were investigating whether the wounded man is tied to the migrant moped gang tied to the shooting of an off-duty border patrol agent at Fort Washington Park last year.

Federal authorities did not say what provoked the gunfire, but confirmed that an ICE officer discharged their weapon.

Police Commissioner Jessica Tisch confirmed that seven rounds were fired by at least one ICE agent and made it clear that the “NYPD had no involvement in the federal operation prior to the shooting.”

“At around 4 p.m. today, there was a shooting involving federal law enforcement agents in the Marble Hill neighborhood of the Bronx,” the NYPD said in a post on X. “The NYPD was not involved in the incident and was not on scene at the time of the shooting.

A crowd of roughly 300 Anti-ICE protesters and several cops flooded the area surrounding Allen Hospital, where the wounded man was taken, on Thursday night. The protesters were heard chanting “ICE out of New York Now!”

“We want ICE off our streets. No justice, no peace,” they bellowed.

Politicians, including Public Advocate Jumaane Williams and Dem congressional nominee Darializa Avila Chevalier, also held a press conference blasting ICE near the scene on Thursday evening.

The protest turned violent late into the night when cops and demonstrators tussled over barricades, pushing on either side. Avila Chevalier was knocked to the ground in the chaos and multiple protesters were cuffed by the NYPD, footage shows.

Iris Rosa, 67, who has lived in the Marble Hill neighborhood for 30 years, said she was almost a “victim” as the shots rang out as she was turning the corner.

“We were turning the corner when the shots rang out. And I heard this —  ‘pow,’ ‘pow,’ ‘pow’ —  like really loud shots,” Rosa said.

“We ran for our lives. Everyone ran. The children were running down the block for their lives.”

Rosa said the child who was in the car was being held by a person who appeared to be an ICE agent after the shooting.

The wounded man was bloodied. had “cuts around his neck,” and appeared to be going in and out of consciousness, she said.

Witness Cynthia Michel heard gunshots from her apartment and went outside to find the harrowing scene.

“I heard the gunshots from my apartment, came outside, saw that it was a man running from this area with an assault rifle … they had the man on the floor with his hands behind his back. He was screaming that they’re going to kill him, that he was going to die, that he doesn’t want to die,” Michel said.

“The 5-year-old boy was screaming for his father,” she added.

Michel added that family members eventually picked up the young boy, as a crowd gathered and screamed at agents to give the man medical attention.

Mamdani and other lawmakers expressed outrage at the ICE-involved shooting and called for federal agents to stay away from the city.

“This is an unconscionable and incredibly serious situation. I have called the President; when we speak I will demand that he ends all ICE enforcement actions in our city. I will not stand by while ICE agents terrorize our communities,” Hizzoner said.

“Get ICE out of our neighborhoods. Get ICE out of our hospitals. Get ICE off our streets. Get ICE away from our children,” he continued. “Abolish ICE.”

Congressman Adriano Espaillat, who represents Upper Manhattan and parts of the Bronx, said he was on the scene after being briefed by the NYPD.

“I am demanding all body camera footage and evidence be preserved, a full investigation with full cooperation from the federal government, and accountability,” Espaillat wrote in a post on X. “ICE is a rogue agency that must be reigned in.”

City Council Speaker Julie Menin alsoreleased a statement calling for a full investigation into the shooting and said she was “deeply worried” about immigrant New Yorkers’ “anxieties” following the incident.

“I recognize the immense fear that ICE’s actions have caused immigrant New Yorkers, and I’m deeply worried about the additional anxiety and uncertainty this incident may bring to communities across our city as we await answers.”

“New Yorkers are outraged tonight. Immigrant communities are terrified. And we are demanding answers,” Gov. Kathy Hochul said in a statement.

She said she has spoken to President Trump and DHS Secretary Markwayne Mullin to demand answers on the shooting.

“I expressed outrage on behalf of New Yorkers and urged them to halt ICE enforcement operations in New York,” she wrote on X.

“I also asked that any body camera footage of the shooting be released to the public so we can establish the facts and get to the truth.”

Rep. Alexandria Ocasio-Cortez also slammed the ICE-involved shooting.

“ICE is a rogue, lawless paramilitary and surveillance agency,” she said in a statement. “It does not belong in New York City and it should not exist in the United States of America. Abolish ICE.”
