Lindsay Clancy’s lawyer makes sobering admission about a potential second trial after deadlocked jury goes home for the day
Lindsay Clancy couldn’t handle a second trial emotionally, her lawyer told reporters on his way out of court.
“She had a flat affect, she’s sad,” defense attorney Kevin Reddington said about Clancy’s demeanor over the course of the deliberations — which are slated to stretch into a fifth day tomorrow.
Reddington said, “No” when asked if Clancy would be able to emotionally handle going through trial again.
The trial could potentially end in a deadlock and a retrial after jurors indicated this morning they were deadlocked. The judge told them to keep deliberating.
Reddington said the decision-making process “could be a while. As long as they are willing to keep working.”
As for a retrial, Reddington said if Plymouth District Attorney Timothy Cruz reduced the charges to second-degree murder it would allow for Clancy to opt for a bench trial rather than a jury trial. Bench trials can be more streamlined and less theatrical.
“You should asked Mr. Cruz why we are trying on triple homicide first degree, not me,” Reddington said.
