One of the three male jurors in the Lindsay Clancy mistrial believes the outcome would likely be different if the state of Massachusetts decides to retry the killer mom.<\/p>\n

The district attorney who brought first-degree murder charges against Clancy is now weighing whether to go to trial again, negotiate a plea deal, downgrade the charges, or drop them altogether after the high-stakes trial ended with a mistrial on Friday.<\/p>\n

\u201cI think if they tried the trial again the way they did, I think nine times out of 10 a jury would come back with not guilty by reason of insanity,\u201d he told ABC in an interview broadcast Thursday morning on \u201cGMA.\u201d<\/p>\n

\u201cNot a doubt in my mind,\u201d Nick Dargie told Aaron Katersky.<\/p>\n

After a week of deliberations, the 12-member jury \u2013 composed of nine women and three men \u2013 failed to reach a unanimous verdict on whether to convict the 36-year-old Duxbury mother of murder for strangling her three kids, Cora, 5, Dawson, 3, and Callan, 8 months, on Jan. 24, 2023.<\/p>\n

The jury penned a note to Judge William Sullivan on Thursday, warning that they were deadlocked and stating that \u201cone juror refuses to listen to the law.\u201d<\/p>\n

Clancy\u2019s attorney Kevin Reddington attempted to leverage this to convince the judge the lone holdout juror should be dismissed, but he declined to do so and officially declared a mistrial on Friday.<\/p>\n
