Lawyers are supposed to protect and defend America\u2019s justice system.\u00a0<\/p>\n

Kevin Reddington, the Massachusetts attorney defending Lindsay Clancy, seems more like an abuser thereof.<\/p>\n

In what law professor Jonathan Turley described as \u201ca breathtaking abandonment of restraint and decency,\u201d Reddington went after the lone holdout juror in the case of the killer mom \u2014 a (so far) unknown figure who we\u2019re told was one of the panel\u2019s three males.\u00a0<\/p>\n

Reddington, in an unhinged press conference after a mistrial was called, accused the dissident of stealing his fellow jurors\u2019 time: \u201cThey know that they were robbed by one man for whatever his agenda was, who stole seven weeks of the life of these other jurors.\u201d<\/p>\n

He also charged the holdout with hostility toward the disabled \u2014 that is, toward the crazed defendant.<\/p>\n

Citing the Americans with Disabilities Act,\u00a0Reddington claimed that leaving a man who didn\u2019t buy Clancy\u2019s insanity plea on the jury was like leaving a racist on a jury.\u00a0<\/p>\n

\u201cThe scene was a fitting end to a visceral trial,\u201d Turley observed \u2014 \u201cbut it added a vindictive element that should prompt Judge William Sullivan to call out the seasoned defense attorney.\u201d<\/p>\n

Reddington\u2019s inflammatory comments fueled a crowd of Clancy\u2019s supporters, who condemned the local district attorney for, in their view, caring only about the three dead children, and not the suffering of the mother \u2014 you know, the one who admitted killing those children.<\/p>\n

Well.\u00a0\u00a0<\/p>\n

Traditionally, lawyers don\u2019t attack jurors.\u00a0<\/p>\n

Citizen jurors are an important, in fact essential, part of our justice system, and those who serve on juries are performing a public service (for a pittance in pay).\u00a0<\/p>\n

In the short term, Reddington\u2019s remarks risk poisoning a future jury pool in Clancy\u2019s case \u2014 by making future jurors in a retrial afraid to stand by their own views for fear of being hung out to dry.<\/p>\n

Or maybe they\u2019re designed<\/em> to do that.<\/p>\n

His accusations put a target on the holdout juror\u2019s back \u2014 and Internet sleuths, or leaks, are likely to get his name out before the furor dies down.\u00a0<\/p>\n

This sort of harassment may be a breach of legal ethics, and certainly doesn\u2019t reflect well upon the Massachusetts bar or on the legal system that seems to be tolerating it.\u00a0<\/p>\n

Meanwhile, Reddington\u2019s unsupported claim of ADA bias is conceivably actionable, and certainly stupid.<\/p>\n

The jury heard weeks of testimony; public opinion on the case is fractured.\u00a0<\/p>\n

Reddington can\u2019t honestly believe that prejudice was this juror\u2019s only<\/em> reason for dissent.<\/p>\n

That doesn\u2019t mean his effort to disqualify the holdout via a last-minute motion to the Massachusetts Supreme Court was unethical \u2014 just aggressive, and legally weak.\u00a0<\/p>\n

His attempted character assassination after the fact, on the other hand, was just plain wrong.<\/p>\n

Perhaps he has committed the cardinal lawyer\u2019s sin of getting too close to his client, or perhaps he couldn\u2019t stand having victory snatched away from him by a single juror.\u00a0<\/p>\n

Either way, it\u2019s a very bad reflection on Kevin Reddington, who has abused his position as an officer of the court to make these remarks, exhibiting poor judgment and worse behavior by an experienced lawyer who should know better.<\/p>\n

But there\u2019s a bigger issue here.\u00a0<\/p>\n

We have for the last couple of generations seen our political leadership class \u2014 which certainly includes much of the bar \u2014 engage in a game of civilizational Jenga, removing various supporting pillars of our society, one by one, mostly in moments of pique when things don\u2019t go their way.<\/p>\n

Think lawfare prosecutions of political opponents, or using censorship to sway an election.<\/p>\n

This is another such case.<\/p>\n

Our legal system depends on juries.\u00a0<\/p>\n

For juries to do their duty, and to be seen as legitimate, they must be independent, with all members free to vote as their conscience demands.\u00a0<\/p>\n

Twelve individuals, making up their own minds after evaluating the evidence as they see it.<\/p>\n

Free to persuade one another in private deliberations \u2014 and free to reject such persuasion.<\/p>\n

\n<\/div>\n

Sometimes, when a panel cannot unanimously agree, that will produce a hung jury.\u00a0\u00a0<\/p>\n

In our system, that\u2019s a protection for defendants<\/em>: If 12 people can\u2019t agree on their guilt based on the evidence presented, they can\u2019t be convicted.<\/p>\n

If jurors aren\u2019t allowed to stick to their own opinions, juries can\u2019t work.\u00a0<\/p>\n

Reddington should consider carefully if that\u2019s what he really wants.<\/p>\n
