PLYMOUTH, Mass. \u2013 The\u00a0jury deciding Lindsay Clancy\u2019s fate\u00a0could be heading toward a hopeless deadlock, and the judge may be forced to declare a mistrial if he gets a third impasse note, experts predict.<\/p>\n

The 12 jurors, nine women and three men,\u00a0have been\u00a0deliberating for 31 hours spread\u00a0over six days and have sent out two notes saying they can\u2019t reach a unanimous verdict.<\/p>\n

Plymouth Judge William Sullivan Wednesday read a\u00a0last-resort \u201cTuey-Rodriguez\u201d charge, formally urging the panelists to keep at it \u2013 but experts say Sullivan will likely have to\u00a0declare a\u00a0mistrial if they send out a third impasse note.<\/p>\n

\u201cIf they come back after Tuey is read and say we are hopelessly deadlocked, that usually is it and should be it according to the case law,\u201d explained veteran Boston criminal defense attorney Brad Bailey.<\/p>\n

Massachusetts attorneys were abuzz after Clancy\u2019s lawyer, Kevin Reddington, told reporters Wednesday that Sullivan could read Tuey a second time, Elikann said.<\/p>\n

\u201cI researched it and talked to people,\u201d said another Boston lawyer Peter Elikann. \u201cMy reading is you can\u2019t [read Tuey again] but the law is kind of vague.\u201d<\/p>\n

However, Bailey explained if the jury asked the judge to read the Tuey instruction again, then he could.<\/p>\n

Or if they sent out a third note saying they were struggling to reach an agreement but wanted to keep deliberating, the judge wouldn\u2019t have to declare mistrial, Bailey said.<\/p>\n

But if the panel were to notify the court for a third time that they were hopelessly deadlocked, Sullivan wouldn\u2019t have any other option but to call a mistrial, the lawyers explained.<\/p>\n

\u201cI think if they come back a third time, in all likelihood the judge would not continue to push, pressure, and prod them,\u201d Elikann said.<\/p>\n

\u201cI would say they really spent so much time since they said they were deadlocked and at some point it becomes a pointless exercise and I would suspect it\u2019s going to be relatively soon at this point,\u201d he added.<\/p>\n

The jury is deciding whether to find the 36-year-old\u00a0Duxbury mother guilty of first-degree murder\u00a0for strangling her kids, Cora, 5, Dawson, 3, and Callan, 8 months, on Jan. 24, 2023 at their home.<\/p>\n

Reddington asked the jurors to find her not guilty by reason of insanity on the grounds she was allegedly in the throes of severe postpartum psychosis and hallucinating a voice telling her to kill the kids and take her own life.<\/p>\n

Reddington and Clancy both appeared anxious Wednesday at the news of the second note telling the judge the jury couldn\u2019t reach a unanimous verdict.\u00a0<\/p>\n

The defense attorney put his hand on his forehead and closed his eyes, while Clancy sat next to him with furrowed brows.<\/p>\n

When the jury eventually went home for the day, Clancy let out a big sigh.<\/p>\n

Reddington did not immediately return an email seeking comment.<\/p>\n
