{"id":7981,"date":"2026-09-03T10:09:23","date_gmt":"2026-09-03T10:09:23","guid":{"rendered":"https:\/\/metrotransitreview.com\/?p=7981"},"modified":"2026-09-03T10:09:23","modified_gmt":"2026-09-03T10:09:23","slug":"9-11-terrorists-keep-dodging-justice-as-lefty-allies-wage-legal-jihad","status":"publish","type":"post","link":"https:\/\/metrotransitreview.com\/?p=7981","title":{"rendered":"9\/11 terrorists keep dodging justice \u2014 as lefty allies wage &#8216;legal jihad&#8217;"},"content":{"rendered":"<div>\n<p>A quarter-century after 9\/11, the attack\u2019s evil mastermind, Khalid Sheikh Mohammed,\u00a0still hasn\u2019t been tried and sentenced to death \u2014 because America\u2019s own justice system has been turned against us.\u00a0<\/p>\n<p>Read more <a href=\"https:\/\/metrotransitreview.com\/?p=7979\">Ukraine\u2019s drone parade marches ahead \u2014 as the Pentagon veers the wrong way<\/a><\/p>\n<p>Blame the American Civil Liberties Union, in large part, for this travesty.<\/p>\n<p>The ACLU\u00a0intervened at the start, insisting that the two military lawyers\u00a0assigned to defend Mohammed and his co-defendants \u201cmight not have death penalty experience\u201d\u00a0and were unprepared to battle \u201cthe full force of the US government.\u201d \u00a0<\/p>\n<p>What a pity.<\/p>\n<p>The ACLU sent in its own team of expert capital defense lawyers,\u00a0at a cost of millions\u00a0of dollars.\u00a0<\/p>\n<p>Ever since, this team has been waging legal jihad \u2014 and it\u2019s still getting away with it. \u00a0<\/p>\n<p>The terrorists\u2019 lawyers have strung out the military court proceedings at Guantanamo Bay, objecting that the defendants weren\u2019t read their rights and were wrongly subjected to CIA waterboarding and other torture.<\/p>\n<p>The real torture victims are the 9\/11 families, still waiting for justice and closure.<\/p>\n<p>From the start,\u00a0the ACLU insisted\u00a0that foreign terrorists deserve the same due-process rights and presumption of innocence as any American.<\/p>\n<p>Wrong: These animals don\u2019t deserve the protections of our Constitution.<\/p>\n<p>Nor do they deserve the rights of legitimate soldiers under the Geneva Convention; Mohammed and his underlings rejected the rules of war to massacre civilians without warning.<\/p>\n<p>But their lawyers \u2014 including Gary Sowards, who once defended Unabomber Ted Kaczynski \u2014 have repeatedly run circles around military prosecutors with endless pretrial motions and multiple attempts to negotiate a plea deal that takes a death sentence off the table.<\/p>\n<p>Now, 25 years after the attack, justice is further out of reach than ever.<\/p>\n<p>The latest blow came last Friday, when Lt. Col. Michael Schrama, the <em>fifth<\/em> military judge to preside in the case, issued a lopsided ruling that gives the terrorists\u2019 lawyers\u00a0everything they want.\u00a0<\/p>\n<p>Two days after setting a June 2028 trial date \u2014 obviously feeling no urgency to provide justice \u2013 Schrama ruled that the terrorists\u2019 confessions and other evidence acquired at Guantanamo will not be allowed in court.<\/p>\n<p>He said interrogators failed to explicitly tell Mohammed that he had a right to remain silent and to consult a lawyer, or that what he told them could be used against him at trial.<\/p>\n<p>More outrageous, Schrama ruled\u00a0that the torture and isolation the terrorists endured at the hands of CIA agents prior to their arrival at Guantanamo conditioned them to tell interrogators there anything they wanted to hear.<\/p>\n<p>Read more <a href=\"https:\/\/metrotransitreview.com\/?p=7977\">Mystery animal terrorizing New Hampshire neighborhood after attacking 3rd person<\/a><\/p>\n<p>Sowards said Schrama\u2019s\u00a0ruling \u201cserves as a civics lesson for why the government shouldn\u2019t engage in such shameful conduct.\u201d<\/p>\n<p>Nonsense. Waterboarding and other methods were used soon after Mohammed\u2019s arrest in 2003 in a desperate effort to learn whether other attacks on the US were planned.\u00a0<\/p>\n<p>He admitted his role to the FBI in 2007 \u2014 and then,\u00a0in 2024, Mohammed signed a written statement as part of an unsuccessful plea deal in which he confessed to planning and executing the 9-11\u00a0attacks \u201cfrom A to Z.\u201d<\/p>\n<p>Prosecutors\u00a0also have a hard drive seized during Mohammed\u2019s arrest,\u00a0which contains photographs of the19 hijackers and three letters from Osama bin Laden.<\/p>\n<p>Even so, Schrama essentially is excluding any confessions \u2014 making a conviction much more difficult.<\/p>\n<p>Prosecutors have not yet announced whether they will appeal the ruling.<\/p>\n<p>They should \u2014 all the way to the US Supreme Court.\u00a0<\/p>\n<p>It\u2019s time to correct the high court\u2019s long-ago 2008 error in\u00a0Boumediene v. Bush, when the justices ruled 5-4 that terrorists being tried in military panels are entitled to the same due-process protections as a defendant in any American courtroom.\u00a0<\/p>\n<p>That was a mistake.<\/p>\n<p>Justice Antonin Scalia,\u00a0writing in dissent, cautioned that the ruling\u00a0imposed \u201can impossible task\u201d on military courts at a time when \u201cAmerica is at war with radical Islamists.\u201d\u00a0<\/p>\n<p>The long, unproductive litigation against Mohammed and his co-defendants proves Scalia\u2019s point \u2014 and today\u2019s Supreme Court majority would likely see the foolishness of applying due-process standards to foreign terrorists<\/p>\n<p>These four terrorists are guilty.\u00a0<\/p>\n<p>They\u00a0claimed credit for their deeds\u00a0even before capture.<\/p>\n<p>They deserve to die.<\/p>\n<p>Yet last week, their attorneys made a bid to revive the tabled 2024 plea deal that would spare them from the death penalty.\u00a0<\/p>\n<p>That would be a terrible injustice.<\/p>\n<p>Many Americans oppose the death penalty, for sound reasons.\u00a0<\/p>\n<div>\n<\/div>\n<p>But 9\/11 amounted to a special kind of evil, outside the normal moral order.\u00a0\u00a0<\/p>\n<p>Israel has outlawed the death penalty \u2014 but as Douglas Murray\u00a0points out,\u00a0it\u2019s making an exception for the terrorists who slaughtered unarmed women and children on Oct. 7.\u00a0<\/p>\n<p>For Americans, 9\/11 is comparable.<\/p>\n<p>We who value freedom and decency must demand justice for the victims of the worst crime ever committed against American civilians.<\/p>\n<p>We cannot accept less than the conviction\u00a0<em>and execution<\/em>\u00a0of Khalid Sheikh Mohammed and his co-defendants.\u00a0<\/p>\n<p>Read more <a href=\"https:\/\/metrotransitreview.com\/?p=7975\">Minneapolis shooting suspect Carlton Johnson II allegedly threatened to gun down ex-girlfriend, \u2018kill someone\u2019 as he faced eviction<\/a><\/p>\n<p><em>Betsy McCaughey is a former lieutenant governor of New York.<\/em><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The American Civil Liberties Union is turning America\u2019s own justice system against us \u2014 and keeping Khalid Sheikh Mohammed from paying the price for 9\/11.<\/p>\n","protected":false},"author":1,"featured_media":7980,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[51,11],"tags":[],"class_list":["post-7981","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-betsy-mccaughey","category-opinion"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.6 -
