The financial steward claimed in court docs filed this week that California\u2019s \u201cslayer statute\u201d prevents Nick \u2014 who has been charged with murdering his parents, Rob and Michele Reiner \u2014 from inheriting the money.<\/p>\n

Per Justia Law, the statute prevents a \u201cperson who feloniously and intentionally kills the decedent\u201d from gaining access to \u201cproperty, interest, or benefit under a will of the decedent, or a trust created by or for the benefit of the decedent.\u201d<\/p>\n

\u201cCalifornia has enacted no exception permitting a killer\u2019s inheritance to be used for criminal defense costs,\u201d Lauriann Wright, a lawyer for the professional fiduciary, Jodi Pais Montgomery, wrote in the docs obtained by the New York Times.<\/p>\n

Wright also wrote that under the \u201cslayer statute,\u201d Nick\u2019s portion of his trust fund would be transferred to his sister and brother, Romy and Jake Reiner. <\/p>\n

She noted that although Nick is presumed innocent pending the murder trial, releasing the funds to him now would be \u201cirreversible.\u201d<\/p>\n

In a statement to the Times, Nick\u2019s lawyer, Anita P. Wu, rejected the claim that the law applies.<\/p>\n

\u201cThe slayer statute requires a determination, not a mere accusation,\u201d she said. \u201cNick is presumed innocent and has been convicted of nothing.\u201d<\/p>\n

In June, Nick, 32, demanded access to his $1.5 million trust fund to help him\u00a0cover his legal fees as he fights the murder charges.<\/p>\n

The \u201cBeing Charlie\u201d writer stated in a petition that he was supposed to be paid half of his trust when he turned 30 in 2023 and the other half when he turns 35 in 2028.<\/p>\n

Because the trust is \u201cirrevocable,\u201d Nick \u2014 who has been\u00a0diagnosed with schizophrenia\u00a0\u2014 claimed in the petition that the trustee is not sanctioned to withhold funds from a beneficiary, even if they are deemed incompetent.<\/p>\n

Rob and Michele were found\u00a0stabbed to death\u00a0in their Brentwood, California, home last December. The filmmaker was 78 and the photographer was 70.<\/p>\n

The \u201cAll in the Family\u201d actor and Michele\u2019s death certificates stated they\u00a0died within \u201cminutes\u201d of receiving \u201cmultiple sharp force injuries\u201d\u00a0with a \u201cknife, by another.\u201d<\/p>\n

Their youngest son, Nick, was\u00a0arrested\u00a0and\u00a0charged with two counts of first-degree murder\u00a0for the deaths.<\/p>\n

In February, the screenwriter pleaded not guilty\u00a0to the charges.<\/p>\n

Nick is facing a maximum sentence of life in prison without the possibility of parole or the death penalty.<\/p>\n
