                                        {"id":6492,"date":"2026-08-13T23:13:09","date_gmt":"2026-08-13T23:13:09","guid":{"rendered":"https:\/\/metrotransitreview.com\/?p=6492"},"modified":"2026-08-13T23:13:09","modified_gmt":"2026-08-13T23:13:09","slug":"why-luigi-mangione-may-finally-plead-guilty-in-unitedhealthcare-ceo-murder-and-how-it-could-all-fall-apart","status":"publish","type":"post","link":"https:\/\/metrotransitreview.com\/?p=6492","title":{"rendered":"Why Luigi Mangione may finally plead guilty in UnitedHealthcare CEO murder \u2014 and how it could all fall apart"},"content":{"rendered":"<div>\n<p>Alleged healthcare CEO killer Luigi Mangione could be risking it all if he decides to plead guilty in hopes of avoiding a life sentence \u2014 as the move may backfire in more ways than one.<\/p>\n<p>Read more <a href=\"https:\/\/metrotransitreview.com\/?p=6490\">Architect of Bills\u2019 new $2.2 billion stadium makes shock admission after fan uproar over obstructed views<\/a><\/p>\n<p>If the 28-year-old accused assassin is willing to accept responsibility in his federal case for killing UnitedHealthcare boss Brian Thompson, his lawyers would then try to get his state charges tossed because of New York\u2019s rules against\u00a0double jeopardy, or\u00a0being tried twice for the same crime.<\/p>\n<p>But the legal maneuver is dangerous for Mangione, as any double jeopardy arguments are highly uncertain.  <\/p>\n<p>And even if he quashes the state case, he could still wind up spending life behind bars on the federal charges as US prosecutors are expected to demand the max and he will be leaving his fate in the hands of US District Judge Margaret Garnett.<\/p>\n<p>\u201cTheir philosophy is probably, \u2018It cannot get any worse,&#8217;\u201d Seth Zuckerman, a defense lawyer and former Brooklyn prosecutor, told The Post when asked to outline Mangione\u2019s possible legal strategy.<\/p>\n<p>\u201cPutting his fate in the hands of a federal judge is probably an upside play,\u201d Zuckerman added.<\/p>\n<p>Mangione is expected to enter some sort of guilty plea during a Friday morning conference \u2014 with the exact charges unclear \u2014 but sources cautioned that the Maryland prep school grad could still get cold feet at any moment before or even during his appearance.<\/p>\n<p>The alleged killer\u2019s lawyers huddled with him Thursday morning at the Metropolitan Detention Center in Brooklyn, said a source familiar with the matter.<\/p>\n<p>Mangione is charged in the federal case with stalking Thompson, a 50-year-old father of two, leading to Thompson\u2019s death on a Midtown sidewalk in December 2024. He\u2019s not charged with murder in the federal case, but still faces a possible life sentence on the stalking rap.<\/p>\n<p>Mangione separately faces up to life in the state case, where he\u2019s charged with second-degree murder and illegal weapons possession.<\/p>\n<h2><strong>Here\u2019s the latest on accused CEO killer Luigi Mangione\u2019s<\/strong> murder trial<\/h2>\n<ul>\n<li><strong>Why Luigi Mangione may finally plead guilty in UnitedHealthcare CEO murder \u2014 and how it could all fall apart<\/strong><\/li>\n<li><strong>Luigi Mangione expected to plead guilty to federal charges in assassination of UnitedHealthcare CEO<\/strong><\/li>\n<li><strong>Luigi Mangione\u2019s NYC trial rules revealed as court OKs 86 news orgs, anonymous jury \u2014 after concerns of \u2018intimidation\u2019 by sick fans<\/strong><\/li>\n<\/ul>\n<p>Legal experts told The Post that a federal plea could very well derail the state case \u2014 depending on its specific terms \u2014 but that the Manhattan District Attorney\u2019s Office could still fight to take its case to trial.<\/p>\n<p>\u201cThis is exactly what the NY County Prosecutor\u2019s Office has feared \u2014 a plea in the federal case will almost certainly prevent the state prosecution in whole or in part,\u201d said Anna Cominsky, a professor at New York Law School.<\/p>\n<p>\u201cAlthough I do not expect the State to concede and dismiss on double jeopardy grounds, they have an uphill legal battle to keep their case alive after a conviction in federal court,\u201d Cominsky added.<\/p>\n<p>Read more <a href=\"https:\/\/metrotransitreview.com\/?p=6488\">Mamdani\u2019s pied-\u00e0-terre tax unpaused after surprise ruling \u2014 but legal showdown isn\u2019t over yet<\/a><\/p>\n<p>The DA\u2019s office would challenge any proposed federal plea that would \u201cdefeat a just outcome in the state prosecution,\u201d Assistant DA\u00a0Joel Seidemann vowed in a letter filed with the state court last month.<\/p>\n<p>If Mangione were to plead guilty to the federal stalking raps, the state would have a \u201cviable argument\u201d that its murder case is \u201cseparate and distinct from the federal charges\u201d despite the cases dealing with the same underlying killing, said Big Apple-based attorney Rich Schoenstein.<\/p>\n<p>Mangione\u2019s camp would likely counter by pointing to a potential useful legal precedent: A Manhattan judge\u2019s 2019 ruling tossing a mortgage fraud case against President Trump\u2019s one-time campaign manager Paul Manafort on double jeopardy grounds.<\/p>\n<p>Then-Manhattan DA Cyrus Vance had tried at the time to bring a state case against Manafort \u2014 who was in federal prison on a federal fraud conviction \u2014 to try to keep him behind bars in the event that Trump pardoned him, which ended up happening.<\/p>\n<p>Manafort\u2019s lawyer at the time? Todd Blanche, who was recently confirmed as US Attorney General.<\/p>\n<p>Another potential factor that could lead Mangione to take a federal plea is that by doing so he could ask to be sentenced to federal prison rather than a New York state lockup.<\/p>\n<p>Defendants typically prefer the conditions in federal prisons over state prisons, said criminal defense attorney Julie Rendelman, a former high-ranking prosecutor in the Brooklyn DA\u2019s office.<\/p>\n<p>Copping a federal plea would not be without its own risks, however.
