                                        {"id":5811,"date":"2026-07-31T14:41:34","date_gmt":"2026-07-31T14:41:34","guid":{"rendered":"https:\/\/metrotransitreview.com\/?p=5811"},"modified":"2026-07-31T14:41:34","modified_gmt":"2026-07-31T14:41:34","slug":"a-curious-legal-quirk-could-see-luigi-mangione-walk-free-and-a-radical-organization-is-pushing-for-it","status":"publish","type":"post","link":"https:\/\/metrotransitreview.com\/?p=5811","title":{"rendered":"A curious legal quirk could see Luigi Mangione walk free \u2014 and a radical organization is pushing for it"},"content":{"rendered":"<div>\n<p>Luigi Mangione\u2019s radical supporters are leading the charge pushing for a rarely-used legal loophole that could let the suspected healthcare CEO killer walk free \u2014 even if the jury believes he is guilty beyond reasonable doubt of the cold-blooded murder.<\/p>\n<p>Read more <a href=\"https:\/\/metrotransitreview.com\/?p=5809\">Dylan Sprouse\u2019s shady Jared Leto tweet resurfaces amid sexual assault allegations<\/a><\/p>\n<p>The December 4 Legal Committee, which has raised more than $1.5 million for Mangione\u2019s defense fund, is raising awareness about jury nullification, a legal power by which a defiant jury can find a defendant not guilty if they believe the law the accused is charged with breaking is unjust.<\/p>\n<p>While rare since the 19th century, it\u2019s used when a jury wants to \u201csend a message about some social issue that is larger than the case itself, or because the result dictated by law is contrary to the jury\u2019s sense of justice, morality, or fairness,\u201d according to the Cornell Legal Information Institute.<\/p>\n<p>Jamie Peck, one of two spokespeople for the December 4 Legal Committee, described jury nullification to The Times as \u201ca beautiful feature of our justice system and really one of the only safeguards against tyranny that we have.\u201d<\/p>\n<p>Mangione, 28, is accused at both state and federal level of gunning down UnitedHealthcare CEO Brian Thompson on the streets of Midtown Manhattan on Dec. 4, 2024.<\/p>\n<p>He was arrested five days later at a McDonald\u2019s in Altoona, Pa., where police recovered his journal in which he allegedly wrote he wanted to \u201cwack\u201d Thompson and called the killing \u201cjustified.\u201d<\/p>\n<p>He has pleaded not guilty.<\/p>\n<p>Prosecutors may have a difficult time finding impartial jurors in New York City for the politically charged case \u2014 which has sparked intense debate over the US healthcare system.<\/p>\n<p>\u201cYou have a juror pool in New York City that is particularly politically inflamed. It\u2019s a very partisan city, and I think Luigi Mangione has a lot of support in New York City, despite the fact that he\u2019s accused of an egregious murder,\u201d Kenneth Belkin, a criminal defense attorney in New York, told The Times.<\/p>\n<p>Read more <a href=\"https:\/\/metrotransitreview.com\/?p=5807\">NY sues Kalshi over alleged illegal gambling operation as prediction market war heats up<\/a><\/p>\n<p>\u201cI think that\u2019s concerning because if you have a large amount of people that are supporting a [suspected] murderer\u2019s political stance in committing a murder, that raises a real possibility that you could get some jurors on that jury that may not convict, no matter what the evidence says.\u201d\u00a0<\/p>\n<p>\u00a0Jury nullification is not legally sanctioned and attorneys are not permitted to present the concept of jury nullification to the jury \u2014 but it is also not outright forbidden.\u00a0<\/p>\n<p>However, in 2015 two people handing out pamphlets about jury nullification outside of a Denver courthouse were arrested and charged with jury tampering.
