The biological parents of a baby girl born to another couple after an IVF mix-up in Florida are \u201cheartbroken\u201d and would have wanted to fight for custody of the child, according to their lawyer.<\/p>\n

\u201cThey are heartbroken over what has happened, and they also understand that the birth couple are also suffering,\u201d Rob Marcereau, the lawyer for the genetic parents of 6-month-old baby Shea,\u00a0told NBC News.<\/p>\n

\u201cThey had to make the heartbreaking decision to not fight for custody,\u201d Marcereau said. <\/p>\n

Tiffany Score and Steven Mills vowed to remain the baby girl\u2019s \u201cpermanent\u201d parents after coming to a \u201cmutually devised custody agreement\u201d with Shea\u2019s biological parents last week.<\/p>\n

Score and Mills sued the Fertility Center of Orlando and its head reproductive endocrinologist, Dr. Milton McNichol, in January for allegedly implanting the wrong embryo in April 2025.<\/p>\n

The couple, who are both white, discovered the embryo mix-up after Score gave birth to a \u201cnon-Caucasian\u201d Shea on Dec. 11, 2025.<\/p>\n

Shea was later confirmed through DNA testing to be 100% South Asian. <\/p>\n

Her biological parents would have preferred to keep the infant as their own, but knew it \u201cwould have been an incredibly uphill legal battle,\u201d Marcereau continued.<\/p>\n

The couple, however, did not feel that the custody fight would be in Shea\u2019s best interest. <\/p>\n

The decision to hand over custody to Score and Mills was hammered out over several meetings, where the couples shared \u201ca lot of tears and hugs,\u201d Marcereau said.<\/p>\n

Shea\u2019s biological parents also intend to sue the clinic and the doctor for forcing them to make this \u201cagonizing\u201d decision, the attorney added.<\/p>\n

Score and Mills\u2019 lawyer, Jack Scarola, said his clients \u201care committed\u201d to respecting the privacy of Shea\u2019s genetic parents, who have so far kept their identities from the public.<\/p>\n

\u201cThey have begun and intend to continue to foster a relationship of friendship and trust\u201d with the other couple, Scarola said.<\/p>\n

Score and Mills also informed the judge they\u2019d chosen a new medical center to handle any future IVF, and their embryo had been moved there, according to court papers filed in Orange County court last Friday.<\/p>\n

That embryo will be tested for parentage, and they will \u201cdetermine next steps,\u201d the document said.<\/p>\n

The Fertility Clinic of Orlando previously said that after \u201cthoughtful consideration,\u201d it would shutter by May 20.<\/p>\n
