A pack of Biden-era Department of Education bigwigs covertly defied federal court orders, even after a colleague tried to blow the whistle \u2014 and are still on the job, even though the department has admitted the violations.<\/p>\n

The story starts in 2021, with President Joe Biden\u2019s executive order that banning \u201cdiscrimination on the basis of gender identity and sexual orientation\u201d\u00a0across the entire federal government.<\/p>\n

The folks at Education ran with that, sending out \u201cguidelines\u201d to state officials warning that \u201cTitle IX\u2019s ban on sex discrimination\u201d extends to \u201cdiscrimination based on sexual orientation and gender identity\u201d \u2014 refuse to go along, and your federal funding is at risk.<\/p>\n

Yet Title IX says no such thing \u2014 \u201cgender identity\u201d was a fringe concept when Congress wrote that law in the \u201970s.<\/p>\n

And respecting \u201cgender identity\u201d claims threatens<\/em> other Title IX guarantees: E.g., you\u2019re not, in most Americans\u2019 eyes, protecting women\u2019s rights to privacy if biological males can use their bathrooms, locker rooms and so on.<\/p>\n

Twenty states sued to block enforcement of Education\u2019s diktats, and in 2022 won an injunction blocking the department from enforcing its mandates.<\/p>\n

Yet Education\u2019s Office for Civil Rights ignored that order, launching multiple investigations of \u201cgender identity\u201d grievances in the supposedly-protected states.<\/p>\n

OCR worker Timothy Mattson tried to report this defiance in 2022 \u2014 triggering a coverup.<\/p>\n

His superiors stalled independent investigators from the federal Office of Special Counsel until after the 2024 election, concealing a 25-page memo from a Kansas City regional director that independently backed up many of Mattson\u2019s concerns.<\/p>\n

By early 2025, the courts completely tossed the Biden \u201cguidances,\u201d and Education\u2019s new leadership has now confirmed Mattson\u2019s claims.<\/p>\n

But most of the \u201ccivil servants\u201d at fault are still on the job. This \u201ccircumvention of a binding federal injunction over multiple years and across multiple offices\u201d cries out for \u201caccountability,\u201d warns OSC Chief Counsel Charles Baldis.<\/p>\n
